RETURNS & REFUNDS POLICY

DUE TO PUBLIC HEALTH CONCERNS ARISING FROM THE GLOBAL COVID-19 PANDEMIC, BREATHE99 REGRETS THAT WE CANNOT ACCEPT RETURNS OUTSIDE OF CLAIMS UNDER THE LIMITED WARRANTY. WE APPRECIATE YOUR UNDERSTANDING, AND ASK FOR YOUR CONTINUED SUPPORT IN TAKING MEASURES TO COMBAT THE SPREAD OF THE NOVEL CORONAVIRUS.

Generally

This Returns Policy (this "Policy") is an integral part of the Terms and Conditions between you (the purchaser of our products) and us (Breathe99 PBC). The Terms, this Policy and certain other policies function together as the complete agreement between you and us. You should read each carefully.

Policy

This Policy provides the mechanism and procedures for you to obtain service related to the limited warranty contained in the Terms. Unfortunately we are not able to accept returns outside of the limited warranty at this time.

Nothing in this Policy or the Terms creates any right to refund.

Procedures

To obtain warranty service or replacement under this Policy, you must email our Customer Service Department at support@breathe99.com to obtain a Return Merchandise Authorization ("RMA") number before shipping your product. No returns for warranty service or replacement will be accepted without an RMA number.

We will use reasonable efforts to process all warranty claims in a timely manner. You are responsible for all shipping and handling charges on returned items, except that we may elect to bear the costs of return shipping relating to breaches of the limited warranty in our discretion. You will bear the risk of loss during shipment.

Any refunds will be issued in the manner that we or our payment services provider select, including direct credit back to the credit card used for purchase.

Notwithstanding anything to the contrary, in no case will we process a warranty claim or issue a refund following (i) any use or modification of the products that would void the limited warranty described in the Terms, or (ii) any use of the products that is in a manner not recommended by us.

Special note regarding crowdfunding backers

We are immensely grateful for the support of our backers on Kickstarter and Indiegogo. Your pledges enabled us to launch the B2 MaskTM quickly at a critical time and begin to fulfill our dual corporate missions to create innovative breathing products and to increase access to them for underserved groups.

The Breathe99 products you received following our crowdfunding campaigns are a symbol of our appreciation for that support. The crowdfunding platforms call these items "rewards" because your crowdfunding pledges were not traditional purchases. Think of them as gifts you might receive after supporting a charitable cause – they are a nice perk, but not the primary reason you donated in the first place. Your pledges are being used to continue advancing our mission, and we therefore do not offer refunds, returns, or exchanges on items received as rewards for backing a crowdfunding campaign. We appreciate your understanding of this policy.
